These terms and conditions tells you the terms of use on which you may make use of our website autismcentre.co.uk ("our site"), whether as a guest or a registered user. Use of our site by any person ("you") includes accessing, browsing, or registering to use our site.

Throughout this set of terms and conditions, we (autismcentre.co.uk) are operated by The Autism Centre Limited, a registered limited company ("us","we").

Please read these terms and conditions carefully before you start to use our site, as these will apply to your use of our site. We recommend that you print a copy of this for future reference.

By using our site, you confirm that you accept these terms and conditions and that you agree to comply with them.

  1. Introduction

    Please carefully read this document which outlines the expectations and responsibilities of both, "us" (The Autism Centre Limited, the service) as your service provider and "you" as the client. It details crucial information about our professional services and business policies. This document will constitute a binding agreement between us, which in writing we will refer to as our "Terms of Service".

    These Terms of Service is meant to establish a clear and mutual understanding, and to help us work effectively. Should you have any questions about the Terms of Service or about the service in general, please refrain from agreeing to the Terms of Service and speak to one of the team.

  2. Service Description

    The service provides assessments to determine if an individual meets the threshold to receive a diagnosis of a neurodevelopmental condition, such as autism, or not. By receiving an assessment, it does not mean that you will receive a diagnosis. There may be occasions where you do not receive a diagnosis, but there may be another condition with which we can safely diagnose you. In this instance, we will discuss this with you rather than simply providing that diagnosis.

    We also provide support to neurodiverse individuals and their families. Support is also offered to professionals who wish to either support an individual or wish to receive training on how to support those who have a neurodevelopmental diagnosis.

    We cannot offer second opinions of our own assessments however; you are welcome to seek second opinions elsewhere. Our clinicians are all licensed professionals; and adhere to NICE guidelines for all diagnosis assessment. If thresholds are not met to provide a correct diagnosis, then they will not make that diagnosis.

  3. Eligibility

    To use the Service, the commissioner of our services must be 18 years old and capable of entering legally binding contracts. We can provide our services to those who are at least 7 years old.

  4. User Conduct

    You agree to use the Service in compliance with all applicable laws and regulations, including the UK-GDPR and the Health and Social Care Act 2008. You will not:

    • Provide false or misleading information.
    • Use the Service for any unlawful or prohibited purpose.
    • Attempt to interfere with the Service or its operation.
    • Violate any intellectual property rights of the Service or others.
  5. Payment Terms

    We require full payment to be made before your first session with one of our team. We accept payment via bank transfer and details will be provided when you commission our services.

    We are also able to accept staged payments prior to your session(s). This can be arranged by prior arrangement only. Please contact Matt (matt@autismcentre.co.uk) to discuss this option with him. Should you withdraw from making payments, you will forfeit your part payments, and no refund will be provided. These payments do not constitute entering into a finance agreement and there will be no record of these payments on your credit record. We will never perform a credit scoring exercise on any client.

  6. Cancellation of appointments

    There may be an occasion where you are unable to attend an appointment. You must provide us with at least 48 hours notice of your intention to miss the appointment; otherwise, your session will be charged at the full rate which was agreed with you.

    If you are undertaking an autism assessment, we still need to pay the clinician for the missed appointment and an additional fee of £300 will be required for any stage missed without receiving a 48-hour notice period. Any appointments which are cancelled with more than 48 hours’ notice will be re-arranged for the next available appointment space.

    If you miss more than 2 appointments without letting us know of your intention to cancel the appointment, you will be placed back onto the waiting list, and this may mean a short wait before we are able to offer you another appointment.

  7. Privacy and Data

    Your privacy is important to us. We collect and use your personal information in accordance with our Privacy Policy, which is available on our website. By engaging in our service, you acknowledge and agree to the privacy policy. You specifically consent to us processing your personal data for the purpose of our services under this Terms of Service. If our clinicians are at any point located outside of the UK, you acknowledge and agree that such processing will involve transferring your personal data outside of the UK. You understand that the residing country may have data protection laws that differ from those of the United Kingdom, however, you will retain your rights under the UK Data Protection Act 2018 ("UK GDPR"), and we will implement and maintain appropriate technical and organizational measures to ensure the security and confidentiality of your personal data.

    All sessions and related communication between us are strictly confidential. We will not share any information with any third parties without your consent, except if we are required to do so by law. This is predominantly the case when human safety is concerned such as:

    • If you threaten harm to yourself or another person
    • If we believe a child or protected adult is at risk of harm or abuse
    • If a court instructs us to disclose information
    • If you share information about a proposed act of terrorism or another illegal act
  8. Limitation of Liability

    In no event shall The Autism Centre Limited be liable for any indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with the use or inability to use the Service.

  9. Indemnification

    You agree to indemnify and hold The Autism Centre Limited harmless from any claims, liabilities, damages, and expenses arising out of or related to your use of the Service or your violation of these Terms.

  10. Amendments

    We reserve the right to amend or modify these Terms of Service with prior written notice to you, and any such changes will become effective 30 days following such notice. The laws of England and Wales will govern these Terms of Service and any disputes arising from or in connection with these Terms of Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. If any part of these Terms of Service is deemed invalid, illegal, or unenforceable, it will not affect the validity of the remaining portions. These Terms of Service reflects our complete understanding and supersedes any prior written or oral agreements regarding its subject matter.

We reserve the right to report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

    1. You may link to the home page of our site, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
    2. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
    3. You must not establish a link to our site in any website that is not owned by you.
    4. Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.
    5. We reserve the right to withdraw linking permission without notice.

    1. These terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. You and we agree to the non-exclusive jurisdiction of the courts of England and Wales.

Disclosure of your information

We may share your information with selected third parties including:

  1. Business partners, suppliers and sub-contractors for the performance of any contract we enter into with them or you.
  2. Analytics and search engine providers that assist us in the improvement and optimisation of our site.
  3. LinkedIn (www.linkedin.com) in the event that you choose you login to the forum with your LinkedIn details your information will be shared with LinkedIn. LinkedIn’s privacy policy and terms and conditions of use are located here: http://www.linkedin.com/legal/privacy-policy?trk=hb_ft_priv.

We may disclose your personal information to third parties:

If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; or to protect the rights, property, or safety of our subscribers, or others.

Where we store your personal data

All data that we collect from you will be stored at a destination within the United Kingdom on our secure servers.

However, we cannot guarantee that data shared with third parties will not be transferred to, and stored at, a destination outside the United Kingdom ("UK"). It may also be processed by staff operating outside the UK who work for us or a third party. By submitting your personal data, you agree to this transfer, storing or processing.

Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk.   1. How we collect your information

    We may collect your personal data in a number of ways, for example from the information you provide to us when you interact with The Autism Centre Limited, if you provide us with your contact details to us by:

    • Make an enquiry via our website, or other network site enquiry forms

    Your contact details, your reason for contacting us and a record of any services provided to you may be stored on our Customer Relationship Management database ('CRM').

  4. Who we share personal data with

    For the purposes referred to in the privacy notice, we may share your personal data with certain third parties for the purposes of delivering our services. This will be in accordance with your preferences provided when applicable. We will not share your personal data with third parties except:

    • We may use a third party provider to deliver our email communications and or to distribute postal services. They are only allowed to use this information to send out the communications specified by us and are required to securely delete the information once communications have been sent;
    • Where we are running an event in partnership with a third party, it may be necessary to share your personal data. If this is the case, we will always make this clear during the registration process and provide the name of the third party;
    • We may share information, if legally required with regulatory bodies and auditors, for example if records had to be lawfully inspected by a regulator such as the Information Commissioners Office;

    If we use or share information with a third party as detailed above, we will always ensure that appropriate controls are in place to ensure data is safe, it is only used for the allowed purpose and it is permanently deleted after the task has been completed.

    The CRM used to store your data is kept on a secure cloud network with data centers within the in the European Economic Area ("EEA"). However, some of the personal data we process about you may be transferred to, and stored at, a destination outside the EEA, for example where it is processed by staff operating outside the EEA who work for us or for one of our suppliers, or where personal data is processed by one of our suppliers who is based outside the EEA or who uses storage facilities outside the EEA.

    In these circumstances, your personal data will only be transferred on one of the following bases:

    • where the transfer is subject to one or more of the "appropriate safeguards" for international transfers prescribed by applicable law (e.g. standard data protection clauses adopted by the European Commission);
    • a European Commission decision provides that the country or territory to which the transfer is made ensures an adequate level of protection; or
    • there exists another situation where the transfer is permitted under applicable law (e.g. where we have your explicit consent).
  5. Will you be contacted for marketing purposes?

    We will only send you marketing emails or contact you via your selected preference selections where you have expressly agreed to this. We may personalise the message content based upon information you have provided. You can update your preferences at any time see section 8 below.

  6. How we keep your data safe

    We are committed to safeguarding your personal data. Whenever you provide such information, we are legally obliged to use your information in line with all applicable laws concerning the protection of personal information, including the Data Protection Act 1998 and from May 2018 the General Data Protection Regulation. In relation to all our records these are held within a dedicated and secure CRM system and or our secure network with access limited on a need to know basis. A range of administrative, technical, physical security controls are used to ensure a robust approach to protecting data held on our IT systems, and when approved transfers between third parties are undertaken.

  7. How long is your information kept?

    We will hold your personal information within a secure dedicated database for as long as is necessary to provide the activities requested. Where you have indicated you no longer wish to receive any services your information will be retained and securely and permanently destroyed in accordance with the our retention and destruction policy.

    Where a record has not been used and or there is no active engagement (for example there has been no response to required correspondence), we may class the record as dormant or may delete the record in accordance with the our retention and destruction policy. When appropriate we will email you to confirm your preferences and to notify you of any intention to delete your records if no response is received.

  8. How we keep your information up to date and Communication preferences

    Under the Data Protection Laws, you have the following rights:

    • to obtain access to, and copies of, the personal data that we hold about you;
    • to request that we cease processing your personal data if the processing is causing you damage or distress;

    • to request us to correct the personal data we hold about you if it is incorrect;

    Once the GDPR comes into force in May 2018, you will also have the following additional rights:

    • to request us to erase your personal data;
    • to request us to restrict our data processing activities;
    • where our processing is based on your consent, you may withdraw that consent, without affecting the lawfulness of our processing based on consent before its withdrawal;
    • to receive from us the personal data we hold about you which you have provided to us, in a reasonable format specified by you, including for the purpose of you transmitting that personal data to another data controller;
    • to object, on grounds relating to your particular situation, to any of our particular processing activities where you feel this has a disproportionate impact on your rights.

    Please note that the above rights are not absolute, and we may be entitled to refuse requests where exceptions apply.
